Still Healing LLC is powered by Shopify. Yet, any sales and purchases are between you and Still Healing LLC. Shopify is not responsible for contractual obligations arising from purchases through the Services. By using the Services, you acknowledge Shopify’s role as the platform provider.

The total liability to you for any claim arising out of these Terms or the Services is limited to the greater of (a) the amount paid by you for the product or service giving rise to the claim in the twelve months preceding the event, or (b) USD 100. SECTION 18 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Still Healing LLC, Shopify, and their affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims arising out of your breach of these Terms, your violation of law, or your access to and use of the Services. We will notify you of indemnifiable claims and may control the defense and settlement at your expense. Cooperation in defense is required.

These Terms and any disputes arising out of or related to them shall be governed by the laws of the state where Still Healing LLC is headquartered, without regard to its conflict of law rules.

Any dispute, controversy, or claim arising from or relating to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, in the state of the headquarters of Still Healing LLC. The arbitrator shall have the authority to grant any relief that would be available in a court of law. The arbitration proceedings and any resulting award shall be confidential. This does not prevent either party from seeking temporary or preliminary relief in a court of competent jurisdiction to protect its rights pending the conclusion of arbitration. The parties agree to a waiver of class actions; no class arbitration or consolidation of claims is allowed.
